Former Barca defender Dani Alves given four and half years prison sentence for sexual assault

Former Barcelona player and Brazil international Dani Alves, has been found guilty of sexual assault and sentenced to a four and half years prison term.

A Spanish court in Catalonia on Thursday, found 40-year-old Dani Alves guilty of sexually assaulting a woman in a Barcelona nightclub in 2022, thereby sentencing him to four and half years in prison.

Per reports, the court also fined Alves a sum of $162,990 to be paid to the victim.

Spanish court and prosecutors issue statement on Dani Alves prison sentence

Following the judgement, the Audiencia Provincial de Barcelona (Catalonia’s top court which passed the sentence) said in a statement, via Reuters:

“It has been proven that the victim did not consent, and that there is evidence, in addition to the testimony of the plaintiff, to consider the rape proven.”

The court also stated that as well as the victim’s testimony, it considered as evidence of rape that she suffered an injury on her knee after Alves pushed her to the floor, her behavior following the event and the fact that she suffered after-effects.

Spanish prosecutors had asked for a nine-year jail term for Alves while the victim sought 12 years, but the court settled on four and a half, saying it considered a mitigating factor that he had opted to pay the victim the compensation regardless of the outcome of the trial. The ex-Barcelona defender also tried to use the fact that he was drunk on the day of the incident, but the court out-rightly rejected it.

Alves lawyers say they will appeal the sentence

Alves had always maintained the sexual encounter with the woman was consensual, and his lawyers also briefed journalists outside the court that the Brazilian intends to appeal the sentence, which includes a five-year probation upon release and a nine-and-half-year restraining order.

His lawyers also said that they will defend the Brazilian’s innocence until the end. “I can only say that I still believe Alves is innocent,” head of the defense team Ines Guardiola said, while adding that Dani Alves was “coping well.”

Former Barcelona right-back Dani Alves, widely considered one of the greatest ever right-backs in world football, was arrested in January 2023 by police in Spain and has been remanded in prison custody ever since then, until his eventual sentencing this month.
